  3. Internet service provider failures or telecommunications outages

Legal Provisions and Dispute Resolution

11. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with:

  3. If informal resolution is unsuccessful, disputes may be submitted to mediation before pursuing litigation
  4. Each party shall bear its own costs in any dispute resolution proceedings

If any provision of these Terms and Conditions is found to be:

  1. Invalid, illegal, or unenforceable by a court of competent jurisdiction
  2. Such provision shall be modified to the minimum extent necessary to make it enforceable
  3. If modification is not possible, the provision shall be severed from these terms

  1. Constitute the entire agreement between you and ByteWorks
  2. Supersede all prior or contemporaneous communications and proposals
  3. May not be modified except in writing signed by both parties or through our posted updates
  4. No waiver of any term shall be deemed a continuing waiver

We reserve the right to modify these Terms and Conditions at any time:
